Criminal charges against Ing Jiri Fiala were withdrawn

Veronika Valdova

On November 9, 2011, Ing Jiri Fiala and a group of his friends and observers arrived to the Municipal Court in Prague – Ovocny Trh, just to find out that there is no hearing going on as the Judge suddenly and unexpectedly fell ill and they are now free to go home. After a while, the assistant agreed to let the people in the court room for a while, and show Mr Fiala evidence that the hearing was indeed cancelled. It soon became obvious that this cancellation of today's hearing was more likely related to withdrawal of criminal charges by the attorney rather than sudden illness of the Judge. Attorney did not show up. Clearly, he knew that the hearing has been called off.

On November 3, 2011, Ing Jiri Fiala was released from prison Nove Sedlo after 9 months of detention and imprisonment, with no explanation what this sudden decision to set him free is based on. So now, after 9 months in prison, the charges were withdrawn as groundless, and the Judge fell ill to make sure she does not have to explain this monumental judicial blunder to the victim.

There were several very interesting points relating to Fiala's imprisonment discussed by the attending public. First of all, it was the fact that he was held in the worst prison Nove Sedlo, where he as an educated perfectly sane Caucasian male with no court decision to show around stuck out like a sore thumb. This peculiarity was highly suspicious, and Fiala was immediately considered either a white collar fraudster or a child molester. His reputation only improved when the fellow inmates discovered a year old magazine with an article about his case presenting his as a political matter.

Another thing, which is even more serious than the defamation campaign, was non-consensual undeclared medication prescribed by a psychiatrist in mid June 2011 in relation to Fiala's hunger strike. Fiala started a hunger strike after 4 months in detention without charges and without trial, in an effort to demand his right for a fair trial. In mid June he was approached by both prison psychologist and a psychiatrist and given medication allegedly "for his stomach". No diagnostic interviews took place, apart from a brief dialog with the psychologist in which Fiala denied any problems or complaints regarding his mental health. The medication prescribed by the psychiatrist, with whom Fiala had no consultation at all, turned out to be Prosulpin (active ingredient sulpiride), a drug used for the treatment of psychosis associated with schizophrenia or major depressive disorder. Ing Fiala was never informed about the fact that the drug is in fact an anti-psychotic, and it took him 3 months to get the prescription cancelled. Not to take prescribed medication in prison was not possible. All attempts to get a copy of his own medical file failed, as the prison doctors "had no time to give it to him". Making a "psychiatric case" of a person who only defends against abuse of power seems to be a favorite game of Czech authorities.

Ing Jiri Fiala would love to make an interview with the Judge ho signed his detention. She will get enough space to defend and explain her actions in this case.
